Compliance Expert Jim Ganther Joins PALS Roster
DALLAS — Organizers of the sixth annual P&A Leadership Summit have announced that James S. “Jim” Ganther, Esq., co-founder and president of Mosaic Compliance Services, has agreed to address the compliance responsibilities of F&I product providers at this year’s event. PALS 2017 will be held Sept. 12–13 at the Gaylord Texan Resort & Convention Center in Dallas, co-located with the annual Industry Summit.
“Product providers receive the nonpublic personal information of dealership customers. This makes them service providers under the federal Safeguards rule and, as such, they are bound by a number of obligations,” Ganther said, adding that providers have a duty to ensure that dealership personnel are properly trained in the terms and conditions of the products they sell. “Failing those duties could give rise to liability under a negligence theory. Taken together, providers should not rely on dealers to meet all of their compliance requirements.”
Ganther’s 50-minute presentation, “Providers’ Role in Dealership Compliance,” will begin at 3:25 p.m. on Wednesday, Sept. 13. PALS and Industry Summit attendees also are invited to earn onsite compliance certification, which will be offered for no additional charge by Automotive Compliance Education (ACE) for the second consecutive year. ACE’s two-hour review session will begin at 8:30 a.m. on Tuesday, Sept. 12., followed by a 90-minute exam. Attendees must be present for the review session and achieve a score of at least 80% on the exam to earn Automotive Compliance Specialist certification.
